Online Streaming User Agreement

This Online Streaming User Agreement (“Agreement”) is entered into by Steaming Around Yorkshire, hereinafter referred to as the “Service Provider,” and the individual or entity accessing the online streaming services provided by the Service Provider, hereinafter referred to as the “User.”

1. Acceptance of Terms

By accessing or using the online streaming services provided by the Service Provider, the User agrees to be bound by the terms and conditions of this Agreement. If the User does not agree with any part of this Agreement, they must refrain from using the Service Provider’s online streaming services.

2. Description of Services

The Service Provider offers online streaming services that allow Users to access and view audiovisual content provided by the Service Provider or its authorised licensors. The specific features and content available through the online streaming services may vary and are subject to change at the discretion of the Service Provider.

3. User Obligations

3.1. Compliance with laws: the User agrees to comply with all applicable laws and regulations governing their use of the online streaming services, including but not limited to copyright laws, privacy laws, and laws related to acceptable online conduct.

3.2. Use Restrictions: the User agrees not to engage in any of the following activities while using the online streaming services:

• Attempting to access unauthorised areas of the Service Provider’s systems or networks.
• Circumventing any security measures or technological protections employed by the Service Provider.
• Uploading, posting, or transmitting any content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.
• Distributing or sharing access to the User’s account with any third party without the Service Provider’s prior consent.
• Interfering with the proper functioning of the online streaming services or disrupting the experience of other Users.

3.3. Intellectual Property Rights: the User acknowledges that all content made available through the online streaming services, including but not limited to videos, audio recordings, images, and text, is the property of the Service Provider or its licensors and is protected by copyright laws and other intellectual property rights.

4. Privacy and Data Security

The Service Provider is committed to protecting the privacy and security of User information in accordance with its Privacy Policy. By using the online streaming services, the User consents to the collection, use, and disclosure of their personal information as described in the Privacy Policy.

5. Disclaimers and Limitations of Liability

5.1. Availability of Services: the Service Provider makes no guarantees regarding the availability or uninterrupted operation of the online streaming services. The User acknowledges that temporary disruptions or outages may occur due to maintenance, upgrades, or other factors beyond the Service Provider’s control.

5.2. Content Accuracy: the Service Provider does not warrant the accuracy, completeness, or reliability of any content made available through the online streaming services. The User agrees to use their discretion when relying on such content for any purpose.

5.3. Limitation of Liability: in no event shall the Service Provider be liable to the User or any third party for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of the online streaming services, regardless of the cause of action and even if the Service Provider has been advised of the possibility of such damages.

6. Termination

Steaming Around Yorkshire reserves the right to suspend or terminate the User’s access to the online streaming services at any time and for any reason, without prior notice or liability.

Should online streaming be withdrawn as part of a planned withdrawal, Steaming Around Yorkshire will inform all users of the upcoming removal of content, with 12 calendar weeks notice. Should this occur the User has the ability to download content to store on their device.

7. Entire Agreement

This Agreement constitutes the entire agreement between the User and the Service Provider regarding the subject matter herein and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter.

8. Amendments

The Service Provider reserves the right to modify or amend this agreement at any time. Any changes to this agreement will be effective upon posting the revised version on the Service Provider’s website or through other appropriate means of notification.

By accessing the online streaming services provided by the Service Provider, the User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement.
